MOUNT CARMEL — Omar Natividad Gutierrez, 34, of Mount Carmel, was sentenced to five and a half years in state prison after taking a plea agreement conviction of aggravated driving a vehicle while under the influence of alcohol, causing death.

The charge was filed in connection with a February crash on Illinois Route 1, which killed Phillip E. Orr of Grayville.

According to the charging information, Gutierrez was northbound in a 2004 green Nissan SUV on Illinois Route 1, half a mile southwest of East 960 Lane in Wabash County, when he was involved in a crash that resulted in Orr's death.

Gutierrez was charged with a Class 2 felony count of aggravated driving a vehicle while under the influence of alcohol, and three misdemeanor traffic violations, which were dropped in the plea agreement. Gutierrez will serve five and a half years, with two years probation. He must serve 85 percent of the sentence and also complete a substance abuse program.
